1. Agreement
These Terms of Service ("Terms") are an agreement between you and Braylin Selvig ("we," "us," or "our"), an individual developer. They cover your Braylin Selvig account (your "Account"), braylinselvig.com, and every website or app that lets you sign in with your Account (each a "Connected Site," and together with braylinselvig.com, the "Services").
Our Privacy Policy explains how we handle your information and is part of these Terms. By creating an Account, checking the box that says you agree, or using the Services, you accept these Terms. If you don't agree, don't create an Account or use the Services.
2. Who can have an account
You must be at least 18 years old and able to form a binding contract to create or use an Account. By creating one, you confirm that you are. You may not use the Services if the law where you live prohibits it, or if we have previously removed you from them.
Accounts are for individual people. Create only one for yourself, don't create one for someone else, and don't sell, transfer, or share it.
3. Your account
- Accurate information. Give a real email address you can access, and keep it current. We use it to confirm your Account, reset your password, and send security notices.
- Security. Keep your password private and don't reuse one you use elsewhere. You are responsible for activity on your Account unless it results from our failure to keep the Services secure. If you think someone else has accessed your Account, change your password, use "Sign out everywhere" on your account page, and tell us at support@braylinselvig.com.
- Profile. Your display name, username, and picture can be seen by Connected Sites you sign in to and may be shown to other people on those sites. Don't choose a name or picture that impersonates someone, infringes someone's rights, or is offensive. We may reclaim or change a username that breaks these Terms.
- Account-wide changes (email, password, profile, deletion) happen only on braylinselvig.com/account.
4. Connected sites
Your Account lets you sign in to Connected Sites without making a separate account on each. The first time you sign in to one, we show you what it will be able to see and ask you to approve. You can disconnect a site at any time from your account page.
These Terms apply to every Connected Site. A Connected Site may also have its own terms or rules for its particular features (for example, a game's rules or a league's scoring). If those conflict with these Terms, the site's terms control for that site only.
Each Connected Site keeps its own data separate. One site can't see what you do on another.
5. Acceptable use
You agree not to:
- break any law, or help anyone else do so, through the Services;
- harass, threaten, defraud, or harm other people, or post content that is illegal, hateful, sexually exploitative, or that violates someone's privacy or intellectual property;
- access an account, data, or part of the Services you aren't authorized to, or try to get around sign-in, permissions, rate limits, or any security or isolation measure;
- probe, scan, or test the Services for vulnerabilities without our written permission (if you find one, please report it to support@braylinselvig.com);
- interfere with or overload the Services, or upload malware;
- scrape, crawl, or collect data from the Services by automated means, except through features we provide for that purpose;
- create accounts by automated means or in bulk, or cheat, exploit bugs, or manipulate scores, rankings, or results on a Connected Site;
- use the Services to send spam or unsolicited advertising; or
- copy, resell, or offer the Services to others as your own.
6. Your content
"Your Content" is anything you add to the Services: your profile, picture, and whatever you save, upload, or post on a Connected Site. You keep all of your rights in Your Content.
You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, and display Your Content only as needed to operate, secure, and improve the Services and to show it where you choose (for example, to other players on a Connected Site). This license ends when you delete Your Content or your Account, except for copies that remain for a limited time in backups, or that we must keep to comply with law.
You are responsible for Your Content and confirm you have the rights to share it. We don't review everything, but we may remove content or limit features if we believe something breaks these Terms or the law.
If you believe something on the Services infringes your copyright, email support@braylinselvig.com with the work, where it appears, your contact details, and a statement that you have a good-faith belief the use isn't authorized.
7. Our content and feedback
The Services, including their software, design, text, graphics, and logos, belong to us or our licensors and are protected by law. We give you a personal, non-transferable, revocable permission to use the Services as these Terms allow. Some parts may be offered under an open-source license; that license controls for those parts.
If you send us ideas or feedback, we can use them without paying or crediting you.
8. Free, changing services
The Services are free, independent projects built and run by one person. We may add, change, pause, or remove features, Connected Sites, or the Services entirely, at any time. We'll try to give reasonable notice before shutting down a Connected Site you've used, but we can't promise to keep any feature, data, or site available forever, so keep your own copies of anything important.
If we ever introduce paid features, we'll present the price and any additional terms before you pay.
9. Third-party services
The Services rely on providers such as hosting, database, and email services, and may link to or show information from other websites. We aren't responsible for third-party sites or services, and your use of them is subject to their terms.
10. Ending your account
You can delete your Account at any time from braylinselvig.com/account. That permanently deletes your Account, your profile, and the data Connected Sites stored for you, as described in the Privacy Policy.
We may suspend or close your Account, or restrict your access to any part of the Services, if you break these Terms, if we're required to by law, or if your use creates risk or harm to the Services or other people. Where it's reasonable and safe, we'll tell you why. If we close your Account in error, contact us and we'll work to restore it.
Sections 6 (the parts about responsibility for Your Content), 7, and 11 through 16 survive the end of these Terms.
11. Disclaimers
The Services are provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We don't promise that the Services will be uninterrupted, secure, error-free, or that data won't be lost.
Information shown on the Services, including statistics, scores, or projections on a Connected Site, is for entertainment and general information only and isn't professional, financial, or betting advice.
12. Limitation of liability
To the fullest extent allowed by law, Braylin Selvig will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or use, arising out of or related to the Services or these Terms, even if advised of the possibility. Our total liability for all claims related to the Services or these Terms is limited to the greater of (a) the amount you paid us for the Services in the 12 months before the claim arose, or (b) fifty US dollars ($50).
Some places don't allow certain warranty disclaimers or limits on liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, such as for fraud or intentional misconduct.
13. Indemnity
To the extent allowed by law, you agree to defend and hold harmless Braylin Selvig from claims, losses, and reasonable legal fees brought by third parties that arise from Your Content, your misuse of the Services, or your violation of these Terms or of someone else's rights.
14. Governing law and disputes
These Terms and any dispute related to them or to the Services are governed by the laws of the State of Nevada and applicable US federal law, without regard to conflict-of-law rules.
Before bringing a claim, please email support@braylinselvig.com and give us 30 days to try to resolve it informally. If we can't, any claim must be brought in the state or federal courts located in Nevada, and you and we consent to their personal jurisdiction. Either of us may instead bring an eligible claim in small-claims court. If you live in a place whose consumer protection laws give you the right to bring claims in your local courts or under your local law, these Terms don't take that right away.
15. Changes to these terms
We may update these Terms. When we make a material change, we'll update the effective date and version above and ask you to review and accept the new Terms the next time you sign in to braylinselvig.com or a Connected Site. If you don't accept them, you can stop using the Services and delete your Account. Changes don't apply to disputes that arose before they took effect.
16. General
- These Terms, the Privacy Policy, and any site-specific terms you agree to are the entire agreement between you and us about the Services.
- If any part of these Terms is found unenforceable, the rest stays in effect, and the unenforceable part will be enforced as far as allowed.
- If we don't enforce a part of these Terms right away, we haven't waived our right to do so later.
- You can't transfer these Terms or your Account. We may transfer them in connection with a transfer of the Services, and will tell you if we do.
- Neither of us is responsible for delays caused by events beyond reasonable control.
- Nothing in these Terms creates a partnership, employment, or agency relationship.
